Refund & Cancellation Policy

1. If you are a consumer (Verbraucher)

If you are ordering as a consumer (not for a trade or independent professional activity), you have a statutory right to withdraw from your order within 14 days without giving a reason, under §§ 355, 357 of the German Civil Code (BGB).

Early commencement of a service. No payment is taken at checkout. As set out in the Terms, the contract for your order is formed, and design work can begin, once Daniel has confirmed your scope and sent your invoice and project agreement — normally within one business day of your order. By default, we still wait until your 14-day withdrawal period has elapsed before starting substantive design work, even though the contract already exists at that point. If you would rather we start sooner, checkout gives you an optional checkbox, unticked by default: "I'm ordering as a private consumer, and I expressly ask dandesigner to begin work on my project before my 14-day withdrawal period ends. I understand that once the service has been fully performed, I lose my right of withdrawal (§ 356(4) BGB) — and that if I withdraw before it's fully performed, I owe a proportionate amount for the work already done (§ 357a BGB)." Ticking this box is never required to place your order. If you tick it, you are giving us your explicit request to begin work early and your acknowledgement that you lose your right of withdrawal once the service has been fully performed; if you withdraw before that point, you must pay a proportionate amount for the service already provided up to the point you notify us of your withdrawal (§ 357a BGB), calculated against the total price agreed for the tier or quote.

How to withdraw. Send a clear statement (email to support@dandesigner.com is sufficient) before the 14-day period expires, stating your order reference. We will confirm receipt and process any refund due within 14 days of receiving your withdrawal notice, using the same payment method you used to pay, unless we agree otherwise.

2. If you are a business (Unternehmer)

The statutory 14-day withdrawal right above applies only to consumers. If you are ordering for your trade, business or independent professional activity, the following cancellation ladder applies instead:

• Before kickoff (before Daniel has confirmed scope and work has started): full refund of any amount already paid.
• After kickoff, before the first milestone deliverable (e.g. before the audit, scope sheet or first concept direction is delivered): 50% of the applicable tier or quoted price is retained to cover work already performed; the remainder is refunded.
• After the first milestone deliverable: no refund for work completed to that point. Remaining, unstarted scope is cancelled and not billed.

3. Design Subscription (recurring plans)

Subscription plans have no minimum term. Pause or cancel at any time by emailing support@dandesigner.com. Cancelling or pausing before your next monthly billing date stops the next charge; the current paid month is not refunded, as it covers the active or reserved concurrency slot for that period regardless of whether a request was submitted.

4. Our guarantee

The scope agreed at kickoff is the scope you're billed for. If we haven't delivered what's listed on your tier card or quote by the point every included revision round has been used, we keep working until we have, at no additional charge for the deliverables originally scoped.

5. How refunds are issued

Where a refund is due under this policy, it is issued to the original payment method (bank transfer for invoice/SEPA payments, or reversed via the original card payment link provider for card payments) within 14 days of the refund being agreed.
